Terms and Conditions
The terms 'Chelsea Dogs LTD' or 'www.chelseadogs.com' or 'Chelsea Dogs' or 'us' or 'we' refers to the owner of this website. The term 'you' refers to the user or viewer of this website.
1. The contract between us
We must receive payment of the whole of the price for the goods that you order before your order can be accepted. Once payment has been received by us we will confirm that your order has been accepted by sending an e-mail to you at the e-mail address you provide in your order form. Our acceptance of your order brings into existence a legally binding contract between us.
2.1 The prices payable for goods that you order are as set out in our website and on each individual supplier’s product page.
2.2 Depending on what products you order you may be required to pay for your items to be delivered and it might not be possible for us to deliver to some locations. Delivery charges are shown on each individual product page under the delivery tab.
2.a.1 We currently only accept payments through the WorldPay payment system in GBP.
3.1 The customer is to make payment for their selected products by credit or debit card via PayPal. Chelsea Dogs have contracted with PayPal to provide a secure check out method. You do not need to have a PayPal account in order to check out through PayPal.3. Payment
3.2 PayPal guides you against un-authorised use of your credit/debit card and Chelsea Dogs accepts no responsibility or liability for loss arising from any failure in PayPal’s online payment system.
4. Right for you to cancel your contract
4.1 You may cancel your contract with us for the goods you order at any time up to the end of the seventh day from the date you receive the ordered goods subject to the clauses below. You must provide us with a reason for cancelling your contract but you will not have to pay any penalty as long as the conditions within this clause are adhered to.
4.2 Any perishable items you order cannot be cancelled and are non refundable unless they are faulty due to our actions, and we must be notified within 7 days of you receiving the items in question.
4.3 Any items which are selected to be personalised cannot be cancelled or returned unless they are faulty due to our actions, and we must be notified within 7 days of you receiving the items in question.
4.4 To cancel your contract you must notify us in writing by way of email at firstname.lastname@example.org stating your order number. It is the customer’s responsibility to refer to each supplier/ products returns policy which is displayed on the individual supplier/ product pages on Chelsea Dogs website.
4.5 If you have received the goods before you cancel your contract then you must contact us at email@example.com whereby we will supply you with an address to send the goods back to which will be at your own cost and risk. If you cancel your contract but we have already processed the goods for delivery you must not unpack the goods when they are received by you and you must send it back to us at the contact address we supplied to you at your own cost and risk and within 5 working days.
4.6 Once you have notified us that you are cancelling your contract, any sum debited to us through PayPal will be re-credited to you by the same method as you made the payment via PayPal as soon as possible, and in any event within 30 days of your order PROVIDED THAT the goods in question are returned by you and received by us in the condition they were in when delivered to you. If you do not return the goods delivered to you or do not pay the costs of delivery, we will be entitled to deduct the direct costs of recovering the goods from the amount to be re-credited to you.
5. Cancellation by us
We reserve the right to cancel the contract between us if:
5.1.1 We have insufficient stock to deliver the goods you have ordered;
5.1.2 We cannot arrange delivery to your area; or
5.1.3 One or more of the goods you ordered was listed at an incorrect price due to a typographical error or an error in the pricing information received by us from our suppliers.
5.2 If we do cancel your contract we will notify you by e-mail and we will re-credit you any sum deducted by us from you via PayPal using the same method as you used for payment as soon as possible but in any event within 30 days of your order. We will not be obliged to offer any additional compensation for disappointment suffered.
6. Delivery of goods to you
6.1 We will deliver the goods ordered by you to the address given to us for delivery at the time you make your order.
6.2 Delivery will be made within the time frames specified on each individual product page and subject to clause 5 of these terms and conditions we will endeavour to deliver your ordered goods within 30 days of your order. We will notify you by email if, due to circumstances outside of our control we are unable to deliver within the specified time.
6.3 Where Chelsea Dogs is acting as an agent for a supplier the delivery and time frame for the delivery will be the responsibility of the supplier and Chelsea Dogs will accept no liability for failure of delivery or problems arising in transit.
6.3 You will become the owner of the goods you have ordered when they have been delivered to you. Once goods have been delivered to you they will be held at your own risk and we will not be liable for their loss or destruction.
6.4 Chelsea Dogs act as agent for several suppliers and cannot therefore guarantee all ordered products will arrive at the same time. You will therefore accept part delivery of products ordered if more than one item is ordered. Multiple products forming part of an order may be delivered separately.
7.1 If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we will have no liability to you unless you notify us in writing via our email address firstname.lastname@example.org of the problem within 10 working days of receiving the goods in question.
7.2 If you do not receive the goods ordered by you within 30 days of the date on which you ordered them, we will have no liability to you unless you notify us in writing via email of the problem within 40 days of the date on which you ordered the goods.
If you notify a problem to us under this condition, our only obligation will be, at your option:
7.2.1 To make good any shortage or non-delivery;
7.2.2 To replace or repair any goods that are damaged or defective; or
7.2.3 To refund to you the amount paid by you for the goods in question in whatever way we choose.
7.3 Save as precluded by law, we will not be liable to you for any indirect or consequential loss, damage or expenses (including loss of profits, business or goodwill) howsoever arising out of any problem you notify to us under this condition and we will have no liability to pay any money to you by way of compensation other than to refund to you the amount paid by you for the goods in question under clause 7.2.3 above.
7.4 You must observe and comply with all applicable regulations and legislation, including obtaining any necessary customs, import or other permits to purchase goods from our site. The importation or exportation of certain goods to you may be prohibited by certain national laws. We make no representation and accept no liability in respect of the export or import the goods you purchase.
7.5 Notwithstanding the foregoing, nothing in these terms and conditions is intended to limit any rights you might have as a consumer under applicable local law or other statutory rights that may not be excluded nought in any way to exclude or limit our liability to you for any death or personal injury resulting from our negligence.
Unless otherwise expressly stated in these terms and conditions, all notices from you to us must be in writing and sent to our email address email@example.com and all notices from us to you will be displayed on our website from time to time.
9. Events beyond our control
We will have no liability to you for any failure to deliver goods you have ordered or any delay in doing so or for any damage or defect to goods delivered that is caused by any event or circumstance beyond our reasonable control including, without limitation, strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.
10. Product Descriptions
Each product contains a product description and where applicable the description includes an approximate size guideline, colour, returns policy and estimated delivery time frames. Chelsea Dogs reserves the right to refuse orders where the product information or price contains any typographical error or incorrect information.
If any part of these terms and conditions is unenforceable (including any provision in which we exclude our liability to you) the enforceability of any other parts of these conditions will not be affected.
13. Third Party Rights
Except for our affiliates, employees or representatives, a person who is not a party to this agreement has no right under the UK Contracts (Rights of Third Parties) Act 1999 to enforce any term of this agreement but this does not affect any right or remedy of third-party that exists or is available apart from that Act.
14. Governing Law
The contract between us shall be governed by and interpreted in accordance with English law and the English courts shall have jurisdiction to resolve any disputes between us.
15. Intellectual Property Rights
15.1 Chelsea Dogs reserves all intellectual property rights contained in Chelsea Dogs website.
15.2 You must not reproduce or use any of Chelsea Dogs website design, graphics, pictures, images, content or text whether it is owned by Chelsea Dogs or licensed by a third party to Chelsea Dogs for their use.
15.3 You are only permitted to download or print pages from Chelsea Dogs website for personal use.
